Overview
The Points Africa Loyalty Program (“The Program”) was developed in its entirety and is operated by Points Africa, rewarding consumers (“members”) for making purchases at any participating company (“Partners”) that are part of the program.
Program Members
- Membership in the Program is open to residents across Africa who are over the age of 18. If a person under 18 wishes to enroll, a parent or guardian must complete the application and consent to the program’s terms and conditions.
- To enroll for The Program, Members must register their account by:
- joining Points Africa online at www.pointsafrica.com, or
- in the Points Africa mobile app, or
- activating at a Partner location, or
- via the Partner’s customer service.
- Members must register a valid phone number plus name (first and last name) and/or email address to activate their Points Africa account. (Other information is optional). The telephone number is the primary key to all member information, including program purchases at participating Partners plus other program activity.
- Account registration is a prerequisite to accumulate points with Points Africa.
- Members can access their accounts at any time via the Points Africa Mobile App including past program activity. The member’s activity is updated in “real-time”.
- Members may contact Points Africa at any time via their Mobile App, the Points Africa website or directly with a Points Africa CSR.
- Points Africa also utilizes an AI Chatbot to assist members’ questions.
- Member’s personal information is protected in accordance with applicable data protection laws and our Privacy Policy, and will not be shared with unauthorized third parties.
- Members are responsible for keeping track of the number of Points Africa in their account.
Program Currency
- Points Africa reward points (“points”) is the currency issued to the program members as a reward for shopping at participating Partners.
- The points can be redeemed for an array of rewards determined by Points Africa and its Partners.
- The value of a point is defined by each Partner and each Partner shall communicate the points value prior to / and at the point when the member spends for each Partner’s qualifying merchandise and/or services.
Program Reward Points
- Reward points have no expiry unless the member is inactive for a period of 24 months (“Inactive” means the member has not made any purchases, redemptions or completed a program activity for 24 months)
- Any fraudulent behaviour by a member will result in the cancellation of their points and account closure
- Points can be redeemed for goods or services at any participating Partner or special reward options via Points Africa.
- There are no limits on the amount of points that can be redeemed.
- All redemption transactions will be verified through our fraud system in real time to ensure that the member’s account has enough points to cover the redemption and/or the account is in good standing.
- At the point of redemption the points used are deducted from the member’s reward points’ balance.
- Points may be transferred to another Points Africa member with the explicit consent of all parties involved. Verification notices with a unique code will be issued real time to all members involved in the points transfer transaction.
- Bonus points may be earned by members via a special promotion or for being a loyal program member.
- Points awarded for Partner selected merchandise may be placed in a pending status within the member’s account until the refund period/date (as defined by the Partner) has passed. Pending points are not eligible for redemption. The terms and conditions of this action are at the sole discretion of the Partner and their refund policy.
Program Redemption
- A member must have accumulated sufficient Points Africa reward points required for the applicable redemption item.
- When redeeming Points Africa reward points, the member’s Points Africa account will be reduced by the specified number of points required for the reward being redeemed.
- It is at the sole discretion to accept a return of an item purchased with reward points. If the return item is accepted by the Partner, the Member’s account will be credited with the appropriate number of points.
- Points Africa redemption rewards may not be returned for cash.
- Neither the Partner or Points Africa shall be responsible for any loss, damage, defect, injury, death or expense relating to any reward.
- Points Africa Points have no cash value and cannot be exchanged for cash.
- Reward points can only be used to redeem rewards offered in the program in accordance with these terms and conditions
- The rewards are subject to the warranty of the issuing Partner (and their vendors) within the Points Africa program.
- All Points Africa totals, as shown on the purchase receipt, will be deemed to be correct, unless otherwise determined by a Partner at its sole discretion.
- Discrepancies must be addressed with the Partner within sixty (60) days of the date the discrepancy occurred.
Program Partners
- A program Partner is defined as an authorized issuer of Points Africa reward points.
- A Partner is not responsible for any errors or omissions with regard to the Points Africa program including, without limitation, any errors, omissions or delays in the reporting or transferring of Points Africa reward points earned through the Partner.
- Partners determine the conditions under which they will issue Points Africa reward points, in which such conditions may change at any time, without notice.
- A Partner is also not responsible for any loss or unauthorized use of Points Africa reward points
- Members must notify the Partner or Points Africa immediately if they have lost or had their points stolen.
- Partners may set thresholds for points issued and redeemed in collaboration with Points Africa.
- A Partner may receive or disclose personal information (e.g. name, address, phone number, email address) if a Member has requested to link their proprietary card. Any such request shall constitute explicit consent from all parties involved.
General Terms
- Choice of Law and Jurisdiction – These terms are governed by the laws in force in the country of the member’s residence, and members agree to submit to the jurisdiction of the courts in their country.
- Language – All amounts are in the currency of the member’s country unless otherwise noted.
- Currency – All amounts referred to in these terms and conditions are in Cedis unless otherwise noted.
- Severability – If any portion of these terms and conditions shall for any reason be deemed to be invalid or unenforceable by a court of competent jurisdiction, the validity of the remaining portions shall not be affected and shall remain in full force and effect.
Acknowledgment
- The Member acknowledges and agrees to be bound by these terms and consent to the collection and use of personal information for Program administration and relevant offers, in accordance with privacy policies.
Any failure to comply with these terms and conditions, or any violation, fraud, abuse of the Program, promotional offers, misrepresentation of fact or other improper conduct (as determined by Points Africa in its sole discretion) shall result in immediate disqualification from participating in the program plus forfeiture of all Points Africa reward points.
Termination
You may terminate your Points Africa Membership and close your Account at any time without cost or penalty. You should redeem all Points Africa Points in your Account prior to such termination. Any Points Africa Points in your Account at the time you terminate your Points Africa Membership or close your Account will be immediately forfeited, and you will no longer have any rights as a Member or entitlement to any such Points Africa Points. Points Africa Membership also terminates upon the death or personal bankruptcy of a Member.
Limitation of Liability
Points Africa (including its affiliates and representatives) assumes no liability for any reason whatsoever, including without limitation, changes or termination of the Program, errors in account information, unauthorized account access, or tax consequences. Members release Points Africa from related claims or damages.
By joining or participating in the Points Africa Program, you (and your parent or legal guardian, as the case may be) agree to release and discharge Points Africa, our affiliates and representatives, and each of our and their respective officers, directors, agents, representatives, successors and assigns, from any loss, liability, claim, demand, damage or expense asserted by any person or entity including, without limitation, relating in any way to the Points Africa Program, your participation in the Points Africa Program or the accumulation or redemption or use of any product or service obtained in connection with the Points Africa Program.
Furthermore, Points Africa (including our affiliates and representatives) is not liable in any manner for any tax consequences which result from your participation in the Points Africa Program. You are solely responsible for the reporting of any income tax benefits and the payment of any taxes.
In no event shall Points Africa, including our affiliates and representatives, and each of our and their respective officers, directors, agents, successors and assigns, be liable for any direct, indirect, punitive, incidental, special, economic, exemplary or consequential damages of any kind, whether based in contract, tort or otherwise, which arise out of or are in any way connected with your Points Africa Membership, the Points Africa Program or these Terms and Conditions.
